1. The Promotion
This promotion (“Share Your Setup”) is run by EVAKOOL to invite customers who have purchased an EVAKOOL Adventure Motorcycle Fridge (model EKAD18) to submit photos or videos of their fridge in use, for possible use in EVAKOOL marketing. Entrants whose content is selected for use will receive a free 15L Alpine Cooler.
This is not a game of chance. There is no random draw and no purchase of an entry is required beyond having already purchased a qualifying EKAD18 fridge. Selection of content is made at EVAKOOL's sole discretion based on suitability for marketing use. Because selection is discretionary rather than a game of chance, EVAKOOL's current position is that this promotion does not require a trade promotion permit under Australian Consumer Law. This assessment should be confirmed with a solicitor before the promotion is published, as permit requirements can vary by state.
2. The Promoter
EVAKOOL [NEXBERG PTY. LTD.] (ABN [74 065 386 165]) of [2/21 Foster Rd, Burpengary East] (“EVAKOOL”, “we”, “us”).
3. Who Can Enter
To be eligible to enter, an entrant must:
be an individual who has purchased an EVAKOOL EKAD18 Adventure Motorcycle Fridge, either directly from EVAKOOL.com.au or from an authorised EVAKOOL retailer;
- be a resident of Australia;
- be aged 18 years or older; and
- submit content that is their own original work and that they have the right to share (see clause 8).
- Employees (and their immediate families) of EVAKOOL and its marketing agency, Devote Digital, are not eligible to enter.
There is no limit on how many customers can take part. Where a customer submits multiple pieces of content, no more than one reward will be issued per customer, per order, regardless of how many individual photos or videos are selected.
4. Promotion Period
This is an ongoing promotion with no fixed end date. It is offered on a rolling basis to eligible EKAD18 purchasers, including through an automated email sent a set period after a qualifying purchase to allow time for delivery.
EVAKOOL may vary, suspend, or close this promotion at any time, for any reason, without prior notice. Any change will be reflected in an updated version of these terms.
5. How to Enter
Eligible customers will receive an email inviting them to share their setup. To enter, a customer must:
- follow the link in the invitation email to the content submission page;
- upload one or more photos or videos of their EKAD18 in use (accepted formats and file size e.g. JPG, PNG or MP4]);
- optionally provide their Instagram or Facebook handle if they would like to be tagged if their content is used; and
- confirm they agree to these terms and conditions at the point of submission.
One submission is treated as one entry. Entries that are incomplete, unreadable, corrupted, or that do not show the EKAD18 fridge may not be considered.
6. How Content Is Selected
EVAKOOL will review submitted content on an ongoing basis and select content it wishes to use in its marketing, at its sole and absolute discretion. Selection may be based on factors including image or video quality, relevance, and suitability for EVAKOOL's brand and marketing channels.
EVAKOOL aims to notify entrants of the outcome within 14 days of submission, though this may vary depending on volume.
Submitting content does not guarantee it will be selected or used, and does not guarantee a reward. Only entrants whose content is selected for use will receive the reward described in clause 7.
7. The Reward
Each entrant whose content is selected for use will receive one 15L Alpine Cooler, provided free of charge.
The reward is not exchangeable, transferable, or redeemable for cash or any other product.
If the 15L Alpine Cooler becomes unavailable, EVAKOOL may substitute a reward of equal or greater value at its discretion.
Rewards will be sent to the delivery address supplied by the entrant within 10–14 business days] of selection.
EVAKOOL is not responsible for delays, loss, or damage in transit once a reward has been dispatched, though we will work with the entrant and our courier to resolve genuine delivery issues. Entrants are responsible for providing a current and correct delivery address.
8. Licence to Use Submitted Content
By submitting a photo or video, the entrant grants EVAKOOL (and its marketing agency, Devote Digital, acting on EVAKOOL's behalf) a non-exclusive, worldwide, royalty-free, perpetual licence to use, reproduce, adapt, crop, and publish the submitted content across EVAKOOL's marketing channels, including but not limited to its website, social media accounts, email marketing, and paid advertising.
Where an entrant has supplied a social media handle, EVAKOOL will endeavour to tag or credit the entrant when the content is used, but is not obliged to do so and is not responsible for how third-party platforms display or fail to display that credit.
EVAKOOL is not obliged to use any submitted content, and may choose not to publish content it has selected.
9. Content Featuring Other People
If a submission shows any person other than the entrant, the entrant confirms that they have that person's permission to appear in the content and for it to be used by EVAKOOL as described in clause 8. Where a person shown is under 18, the entrant confirms they have the consent of that person's parent or guardian.
The entrant agrees to indemnify EVAKOOL against any claim arising from a failure to obtain the consent described in this clause.
10. Ownership and Warranties
By entering, the entrant warrants that:
- they are the sole owner of the submitted content, or otherwise hold all rights necessary to submit it and grant the licence in clause 8;
- the content does not infringe the intellectual property, privacy, or other rights of any third party; and
- the content does not contain anything unlawful, offensive, defamatory, or otherwise inappropriate.
EVAKOOL may disqualify any entry, and decline to award a reward, if it reasonably believes these warranties have not been met.
11. Privacy
Personal information collected as part of this promotion (including name, email address, social media handle, and delivery address) will be handled in accordance with EVAKOOL's Privacy Policy, available at https://evakool.com.au/policies/privacy-policy . This information will be used to administer the promotion and fulfil rewards, and, where the entrant has opted in, for future EVAKOOL marketing communications.
12. General Conditions
EVAKOOL reserves the right to disqualify any entry it believes, on reasonable grounds, to be fraudulent, in breach of these terms, or otherwise inappropriate.
EVAKOOL reserves the right to vary, suspend, or terminate this promotion, or these terms, at any time without notice.
Nothing in this promotion is intended to exclude, restrict, or modify any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot lawfully be excluded.
To the maximum extent permitted by law, EVAKOOL is not liable for any loss or damage arising from a person's entry into this promotion, other than for the delivery of the reward as described in clause 7.

These terms are governed by the laws of Queensland, Australia
